Consumer right of withdrawal

Client’s right of withdrawal

As a client you have the right to withdraw from this contract within 14 days without having to state your reasons. The period of withdrawal is 14 (fourteen) days from the date of the conclusion of the contract, but not before the receipt of this notice of withdrawal rights on a durable medium (e. g. letter or email). To exercise your right of withdrawal you as the client must notify to us, GrundGut GmbH, Sonnenfeld 14, D-27419 Hamersen, email info@grundgut.de, of your wish to withdraw from the contract by a clear statement e. g. a letter sent by mail or by email. You may use the attached form to state your withdrawal; this is, however, not mandatory. In order to observe the period of withdrawal, it is sufficient for you to send the statement about exercising your right of withdrawal before expiration of the withdrawal period.

Consequences of withdrawal

If you withdraw from this contract, we must reimburse all payments we have received from you promptly or at the latest within 14 (fourteen) days after receiving your statement about exercising your right of withdrawal, including costs of delivery with the exception of additional costs arising from the fact you have chosen another type of delivery than the cheapest offered by us. For the reimbursement we shall use the same method of payment you have used for the initial transaction unless we explicitly agree otherwise. You shall not be charged with fees for this repayment.

If you explicitly requested that we start to provide our services within the period of withdrawal, you shall be obliged to pay an appropriate amount corresponding to the proportion up to the date on which you notify us of exercising your right of withdrawal, equivalent to the proportion of the services provided in relation of the total scope of our services defined in the contract. The proof of the opportunity to conclude a contract or communicating of the proof of the opportunity of a contract complies with the total volume of our service. You shall be obliged to pay compensation for the services provided up to the time of withdrawal only if you have been advised before the delivery of your contract statement of the legal consequences explicitly agree that we will start with the execution of the consideration before the end of the withdrawal period. There is an obligation to pay compensation; this may mean that you shall be required to fulfil the contractual payment obligations for the time period until your withdrawal.

The proof of the opportunity to conclude a contract or the procurement of such a contract corresponds to the total scope of the service. You shall be obliged to pay compensation for the service provided until your withdrawal only if you were advised of this legal consequence before submitting your contractual declaration and have expressly agreed that we will start to perform the consideration before the end of the withdrawal period. If there is an obligation to pay compensation, this may mean that you shall still be required to meet the contractual payment obligations for the period up to your withdrawal. Your right of withdrawal shall expire prematurely if, at your express request, the contract is completely fulfilled before you have exercised your right of cancellation. Obligations to reimburse payments must be fulfilled within 30 (thirty) days. For you as the client, the period shall start on the date when you send your cancellation notice, for us when we receive it.

Expiry of the rights of withdrawal

The right or withdrawal shall become void in the case that the client has expressly consented to the immediate onset of the performance of the service and has at the same time acknowledged that he forfeits his right of withdrawal upon complete performance of the contract by the Real Estate Agent and the Agent has performed the full service.

Consent of immediate processing

In the event that you wish the entrepreneur to begin his activity immediately before the end of the 14-day withdrawal period, you shall be obliged to declare this expressly (e. g. by postal letter or by email) and additionally acknowledge the forfeiture of your right of withdrawal due to the complete fulfilment of the contract. You may use the attached form to state your withdrawal; this is, however, not mandatory.

Your right of withdrawal shall expire when you have expressly consented to the immediate onset of the performance of the service and have at the same time acknowledged that you shall forfeit your right of withdrawal upon complete performance of the contract by the Real Estate Agent and the Agent has performed the full service.
